By accessing or using Business Growth AI Advisor ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Tytarenko Inc. ("Company," "we," "us," or "our").

2. Service Description

Business Growth AI Advisor provides AI-powered business idea validation and comprehensive business plan generation services. The Service includes:

  • Free Assessment: AI analysis of your business idea with viability score (0-10 scale)
  • Premium Business Plan: Detailed 35+ page PDF business plan ($49 one-time payment)
  • Email Delivery: Results and business plans delivered via email
  • Dashboard Access: View assessment history and download purchased plans

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect at any time without prior notice.

3. User Eligibility

You must meet the following requirements to use the Service:

  • Be at least 18 years old
  • Have legal capacity to enter into binding contracts
  • Provide accurate and complete information
  • Not be prohibited by law from using the Service
  • Comply with all applicable laws and regulations

By using the Service, you represent and warrant that you meet these requirements.

4. User Accounts and Data

4.1 Account Responsibility

You are responsible for maintaining the confidentiality of your email and any account credentials. You agree to notify us immediately of any unauthorized access at m@tytarenko.org.

4.2 Data Accuracy

You agree to provide accurate, current, and complete information during the assessment process. The quality of AI-generated recommendations depends on the accuracy of your input.

4.3 Data Ownership

You retain ownership of all business information you submit. By using the Service, you grant us a worldwide, royalty-free license to process your data to:

  • Provide the Service and generate business plans
  • Improve our AI models (anonymized and aggregated)
  • Comply with legal obligations

5. Payment Terms

5.1 Pricing

  • Free Assessment: No cost for viability score and basic insights
  • Premium Business Plan: $49 USD one-time payment
  • All payments processed securely through Stripe
  • Prices subject to change with 30 days notice

5.2 Payment Processing

By providing payment information, you authorize us to charge the specified amount. Payment is required before accessing premium business plan PDFs.

5.3 Refund Policy

30-Day Money-Back Guarantee: If you are not satisfied with your business plan, request a full refund within 30 days of purchase by contacting m@tytarenko.org with your order details.

Refunds are issued to the original payment method within 5-10 business days. To qualify for a refund, you must provide:

  • Your email address used for purchase
  • Assessment ID or order number
  • Reason for refund request (optional but appreciated)

5.4 No Recurring Charges

Business plans are one-time purchases. We do not charge recurring fees or subscriptions. You will only be charged once per business plan purchased.

5.5 Taxes

Prices do not include applicable taxes. You are responsible for all sales, use, and other taxes associated with your purchase.

6. Intellectual Property

6.1 Our Content

All content, features, and functionality of the Service (including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, and software) are owned by Tytarenko Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 License to Generated Content

Business plans generated for you are licensed for your personal or business use. You may:

  • Use the business plan for your own business operations
  • Share with investors, partners, or advisors
  • Modify and adapt the content for your needs

You may NOT:

  • Resell or redistribute business plans to third parties
  • Use the Service to generate plans for resale
  • Reverse engineer or copy the Service's AI technology
  • Remove copyright or attribution notices

6.3 Trademarks

"Business Growth AI Advisor," our logo, and other marks are trademarks of Tytarenko Inc. You may not use our trademarks without prior written permission.

7. Acceptable Use Policy

You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Infringe on intellectual property rights of others
  • Submit false, misleading, or fraudulent information
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service or servers
  • Use automated tools (bots, scripts) without permission
  • Abuse rate limits or attempt to circumvent security measures
  • Harass, threaten, or harm other users or our staff
  • Submit content containing viruses or malicious code

Violation of this policy may result in immediate termination of access without refund.

8. AI-Generated Content Disclaimer

8.1 No Guarantee of Accuracy

Business plans and assessments are generated using artificial intelligence and should be used as a starting point for your business planning, not as definitive advice. We do not guarantee:

  • Accuracy of market size estimates or financial projections
  • Completeness of competitive analysis or risk assessment
  • Suitability of recommendations for your specific situation
  • Success or profitability of your business venture

8.2 Not Professional Advice

The Service does not provide legal, financial, accounting, or professional advice. You should consult with qualified professionals before making business decisions. We are not liable for any decisions made based on AI-generated content.

8.3 Third-Party Verification

You are responsible for verifying all data, conducting due diligence, and validating market assumptions with independent research.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM (MAXIMUM $49)
  • WE ARE NOT RESPONSIBLE FOR ERRORS, INTERRUPTIONS, DELAYS, OR DOWNTIME CAUSED BY THIRD-PARTY SERVICES (AI APIs, HOSTING PROVIDERS)

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Tytarenko Inc., its officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:

  • Your use of the Service
  • Violation of these Terms
  • Violation of any rights of third parties
  • Your business operations or decisions based on generated content

11. Termination

11.1 By You

You may stop using the Service at any time. To delete your data, contact us at m@tytarenko.org.

11.2 By Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of the Service
  • Non-payment of fees

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Previously purchased business plans remain accessible for download for 90 days after termination.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the United States and the State of Virginia, without regard to conflict of law principles.

12.2 Dispute Resolution

Before filing a legal claim, you agree to attempt to resolve disputes informally by contacting us at m@tytarenko.org. We will attempt to resolve the dispute within 30 days.

12.3 Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except you may assert claims in small claims court if they qualify.

12.4 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions or class-wide arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Email to your registered email address
  • Prominent notice on our website
  • Updated "Last Updated" date

Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree, discontinue use immediately.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tytarenko Inc. regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

14.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or AI API outages.
